Terms of Service

1. Acceptance of Terms

By accessing or using BookedBizzy's AI-powered business phone automation service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

BookedBizzy provides AI-powered phone answering, appointment scheduling, quote generation, and business automation services. The Service uses artificial intelligence to handle incoming calls, capture lead information, and integrate with calendar systems on your behalf.

3. Account Registration

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the security of your account credentials
  • You must be at least 18 years old to use the Service
  • You are responsible for all activities that occur under your account

4. Subscription and Payment

  • The Service is offered on a subscription basis
  • Payment is processed securely through Stripe
  • Subscriptions automatically renew unless cancelled
  • You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period
  • No refunds are provided for partial months of service
  • We reserve the right to change pricing with 30 days' notice

5. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Engage in fraudulent, deceptive, or misleading practices
  • Harass, abuse, or harm others
  • Transmit spam or unsolicited communications
  • Interfere with or disrupt the Service or its infrastructure
  • Attempt to gain unauthorized access to any part of the Service
  • Use the Service for any illegal purpose

6. AI Disclosure, Call Recording, and Compliance

BookedBizzy uses artificial intelligence to handle inbound phone calls on your behalf. By using the Service, you acknowledge and agree that:

AI Disclosure

  • Calls are answered by an AI-powered voice assistant, not a human agent
  • The AI assistant will identify itself as an automated system to callers at the start of each call
  • AI responses are generated automatically and may not always be accurate; you are responsible for reviewing and correcting any AI-generated information
  • You must not configure the AI agent to misrepresent itself as a human being

Call Recording

  • Incoming calls handled by BookedBizzy may be recorded and transcribed for quality assurance and service improvement
  • The AI assistant will notify callers that calls may be recorded at the start of each call
  • You are responsible for complying with all applicable call recording laws in your jurisdiction, including two-party consent requirements in applicable states (e.g., California, Florida, Illinois, Pennsylvania)
  • Call recordings are retained for 90 days and automatically deleted thereafter, unless required by law

SMS Communications (TCPA Compliance)

  • The Service may send SMS appointment confirmations to callers who provide their phone number during a call
  • By booking an appointment via phone, callers consent to receive a transactional SMS confirmation for that appointment
  • All SMS messages include opt-out instructions (reply STOP to unsubscribe)
  • You agree not to use the Service to send unsolicited marketing messages or violate the Telephone Consumer Protection Act (TCPA)

Automated Compliance Tools — Disclaimer and Customer Responsibility

BookedBizzy provides automated disclosure tools that attempt to detect applicable legal requirements from a caller's area code and deliver appropriate notices at the start of each call. These tools are provided as a convenience feature on a best-effort basis. By using the Service, you acknowledge and agree that:

  • You are solely responsible for ensuring that your use of the Service complies with all applicable federal, state, local, and international laws and regulations, including without limitation call recording consent laws, AI disclosure laws, and telemarketing regulations (TCPA, FTC, and equivalents)
  • BookedBizzy's automated compliance features are based on our best available information and are subject to error, omission, delay, or inaccuracy — particularly as laws change frequently and without notice
  • BookedBizzy does not warrant that its automated disclosure determinations are legally sufficient in any specific jurisdiction
  • BookedBizzy is not a law firm and does not provide legal advice; nothing in the Service or these Terms constitutes legal advice
  • You are responsible for consulting qualified legal counsel regarding your specific compliance obligations before using the Service
  • If BookedBizzy's automated disclosure system fails to trigger a required disclosure due to system error, unknown area codes, database limitations, or any other reason, that failure does not excuse your independent obligation to comply with applicable law
  • You agree to indemnify, defend, and hold harmless BookedBizzy from any claims, fines, penalties, or damages arising from your failure to comply with applicable disclosure, recording consent, or AI notification laws — regardless of whether BookedBizzy's automated tools did or did not operate as expected

7. Intellectual Property

The Service, including its software, design, and content, is owned by BookedBizzy and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for your business purposes.

8. Data and Privacy

Your use of the Service is subject to our Privacy Policy, which describes how we collect, use, and protect your data.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. AI-GENERATED RESPONSES MAY CONTAIN ERRORS OR INACCURACIES.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOOKEDBIZZY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless BookedBizzy and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service will immediately cease.

13. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or through the Service. Continued use of the Service after changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Delaware.
